The way companies will get around this is really simple, just put all drivers on a salary above the allowed limit of 35,000 per year, then they will not need to worry about paying overtime. This in the end will hurt drivers and their pay more than it will help. I could see companies going over to a model of $40,000 per year salary plus a .20 CPM bonus or a model like that

Some of these comments show why this will have a hard time passing. Demonstrating how far drivers will bend over just to keep a job. A job with an average wage you could make flipping burgers or stocking shelves or doing most anything else for 60 hours a week, seeing your kids, having a life and sleeping in your own bed.

Truck drivers are technically " on-duty " every hour they are in the truck, they are responsible for that truck. If they are on their 10-hour sleeper-berth break, and someone runs into their truck, they have to get up and take care of it. That puts them in " on-duty " status, making them illegal, technically that is. They can't just say, " I'm on my break, come back in 10 hours ". Trucking is like no-other job or occupation in America. It's not a typical 40-hour-a-week-job, where you clock in, work your 8 hours, clock out and go home. Truck drivers don't work 40 hours, it's 70 hours and the truck is your home. There is really no such thing as overtime pay in over-the-road trucking, mainly because drivers get paid by the mile, not the hour. Just pay drivers by the hour when they are sitting, mainly at a dock. If putting truck drivers under the FLSA gets them paid for every hour sitting at docks, then great.

All these company's, that can figure out how to force a driver to max out their recap, can damn sure figure out how to pay overtime. These companies should also be paying the driver for the time that the companies equipment is under their care. Why should a driver baby sit someone else's truck for free?

The ELD can log you driving 60 hours a week (70 hours in eight days). Putting aside all the other stuff a driver does outside that 60 hours, even those 60 hours are on average vastly underpaid (40 hours regular pay, plus 20 hours overtime.

It comes out on average to about $13.50 an hour (based on average trucker pay last year of $47k).

Living conditions aren't ideal, either. It's not like the average driver is living in a motel every night with a toilet and shower in the morning, healthy food out of a fridge, and a big-screen T.V. for h iij s or her leisure.

They're definitely deserving of better pay.

The Government has a tendency to do things that cause more harm than good, they go halfway with things, like the ELD, and they leave things up to interpretation a lot. There really isn't any such thing as " overtime pay " for truck drivers, unless you are paid by the hour. Putting truck drivers under the FLSA will defiantly help by itself, but other things need to be added with it. Like mandated detention time is paid, from the minute a driver arrives. Just pay truck drivers for all their hours worked from the time they do their pre-trip inspection, that is when their time starts. Especially and mainly the time sitting at docks, from minute one, not after 2 hours.

Each and every hour of our time should be paid. We need the same rights as a 15 year old burger flipper making overtime.
Every other industry pays when your on duty also. Police, fire, military, private security, thousands of jobs. When you show up and go on duty and start work doing pre trips that help save lives you should get paid.
We deserve to finally be compensated for our hard work, each and every hour.

I wonder how and who will monitor the new rule? Is this an "Act" or an amendment to the existing Act?
How will drivers that are paid on a basis other than hourly track their hours?
How will accurate time records be kept and honored by the people paying the overtime?
I can see the people responsible to pay the overtime being suspicious of fraud on the time card. It would lead to frustration on both the driver and payer of the overtime.
Would it work to simply pay overtime after a set number of miles per day?
I can see that an industry with a labor force that has believed that the current rate of pay compensated drivers for their time spent that included an "overtime" factor. If they now have to breakout straight time from overtime; I can see an argument for an adjustment to the straight time rate.
Because truck drivers have not been monitored by a clock except for pickup time and delivery time the time spent in between is their own. I do not see how overtime could be reliably calculated for long haul heavy freight. I bet that local daily package delivery service is paid hourly by most employers, the trucks leave from the company yard in the morning and return to the yard in the evening. An easy time clock tracking.

If truck drivers could punch a time clock when they get into a shipper's or receiver's yard and punch it again when they leave and be paid a wage while they wait to be loaded or unloaded; I think that would satisfy most everyone concerned with the overtime issue.

I also believe that the 14 hr day 70 hour week should be revisited by all involved , especially the 2-4 weeks out on the road that many company's want, the Industry needs to become more friendly to incoming younger drivers so they will want to keep trucking.

shea.duncan: I don't know where you heard all that crap from or what kind of drugs you are on. But, it's all bull! Every shipper or company doesn't already pay drivers for sitting at docks, even after 2 hours. Also, why should a truck driver work for free for those 2 hours you are talking about? Do you think the people loading or unloading that trailer work their first 2 hours for free?

This might drive a lot of small trucking companies out of business if this means they will have to pay drivers for every hour sitting at a dock, which everyone should. Other things need to be changed so that don't happen. Big companies can absorb the cost. The time sitting at a dock has to be mandated by a law saying it has to be paid to the carrier or this could cause the small carriers to go out. The Government has a tendency to do things half-ass and cause more problems. Do ELDs ring a bell?

I can see this as a double edged sword it can be great for employee drivers but at least in the beginning I can also see it being catastrophic for small-Medium fleet operators possibly even carrier at all levels until the customers come to realize they will have to pay up and shut up and/or vastly improve the efficiency of their loading and unloading operations.
My next question is how can someone like me (a one truck O/Op) use this to improve my bottom line other then to exercise patience until it trickles down in the rates.....

From a lot of the comments I see in here, a lot of these numb nuts like getting bent over! Of course it's not gonna work for everyone but it's gonna get this stuff out in the open and straighten a lot of this mess out! All this sitting at the dock for 2 & 3 hours for free crap has gotta go
